Florida Landlord-Tenant Law Essentials

No Statewide Rent Control

Florida law (§125.0103) preempts local rent control ordinances. Landlords may raise rent freely with proper notice. Plan for 5–15% annual increases in competitive markets.

15-Day Notice for Rent Increases (Month-to-Month)

On a month-to-month lease, landlords must give 15 days written notice before raising rent. Annual leases are locked until renewal.

Security Deposit Rules

No cap on security deposits in Florida, but landlords must return within 15 days (if no deductions) or 30 days with an itemized list. Common: first + last + 1-month security.

3-Day Notice for Non-Payment

If rent isn't paid, landlords can serve a 3-day notice. This is significantly faster than many northern states. Never miss a Florida rent payment.

Landlord Entry Requirements

Landlords must give 12 hours advance notice before entering (except emergencies). Visits must be at reasonable times — generally 7:30 AM to 8:00 PM.

Pet Deposits & Fees

Florida allows non-refundable pet fees (common: $250–$500 per pet) and/or monthly pet rent ($50–$150). Many buildings in Broward and Palm Beach limit size/breed.

Renting While You House Hunt

Look for month-to-month or 6-month leases — many landlords in Pompano Beach and Deerfield Beach offer flexible terms for incoming relocators.

Ask about HOA restrictions — in condos, the HOA may have separate lease approval requirements, minimum lease terms (often 6–12 months), and application fees ($100–$300).

Check flood zone before signing — even renters should know their flood zone. Renter's insurance with flood coverage is available and strongly recommended near the coast.

Negotiate in slower seasons — the April–September window often yields better pricing and incentives (1 month free, lower deposit) as seasonal residents depart.

Beware of rental scams — South Florida has elevated fraud rates on Facebook Marketplace and Craigslist. Never wire money without viewing the unit and verifying ownership through county property records.
